Heaney remains free on own recognizancePosted: 5/21/02 By Shannon McKinney Joseph Steven Heaney, 24, of Caledonia will remain free on his own recognizance after being charged in connection with an accident that killed Jesse M. Worsley, 20, of Caledonia in November. Heaney appeared in court Monday, May 20, with his attorney Gregory Schultz. Heaney has been charged with four counts of criminal vehicle operation resulting in death which could result in a 10 year maximum sentence and four counts of criminal vehicle operation resulting in substantial bodily harm, which could result in a maximum three year sentence. The charges stem from an accident that occurred November 18, 2001 in which Worsley died from injuries he sustained while a passenger in a vehicle driven by Heaney. Another occupant, Paul Hughes, was injured. According to the complaint, Heaneyís blood alcohol concentration measured over .10 within two hours after the accident. Houston County Attorney Rick Jackson asked that Heaney not be allowed to leave the state. Schultz argued that Heaney drives truck and is often required to leave the state, and sometimes drive to Canada. He added that Heaney is a life long resident of Caledonia and resides with his fiance, who is expecting a child. He has no criminal record and has appeared in court on his own recognizance, said Schultz. Fabian agreed to allow Heaney to travel out of state provided he sign a waiver of extradition. He also is prohibited from using alcohol and mood altering drugs unless prescribed by a physician, he submit to random drug testing, remain law abiding and make all scheduled appearances.
