Jail time possible in theft case

In a story last week entitled ėGuilty plea entered in theft from church,î it was reported that prosecutor Rick Jackson, representing the State of Minnesota, indicated he believed sentencing guidelines are such that ė(Julie) Wittry will not see jail time.î Jackson actually said sentencing guidelines in this case call for a presumptive stay of any prison sentence. In Minnesota, there is a distinction between prison time and jail time. A prison sentence involves incarceration at a state prison, whereas jail time involves commitment to a local jail.

Jackson said after the hearing that, considering the nature of the crime to which Wittry pled guilty, he intends to argue at the sentencing hearing that jail time be included in Wittryís sentence.
