La Crescent man facing sexual conduct charge
Wayne Alan Polus, 109 Hillview Boulevard, La Crescent, was charged in Third District Court on August 30 with third degree criminal sexual conduct.
The crime, a felony, carries a maximum sentence of 15 years in prison and/or $30,000 fine.
Polus, 48, allegedly assaulted a woman while she was sleeping on a couch at his parentsí home, where he resides, early on the morning of August 29.
The woman told La Crescent Police Chief Todd Nelson and Houston County Sheriffís Department Lieutenant Tracie Erickson that she woke up during the assault and told Polus to stop and that he did so.
Polus told the officers that he had not had any contact with the woman, who is described in the complaint as ìmentally impaired, mentally incapacitated, or physically handicapped.î
Polus also had a blood alcohol concentration of .15 at the time of the alleged incident, according to the report.
In the courtroom on Monday, county attorney Rick Jackson asked for bail at $20,000 unconditional or $10,000 conditional. Polus told the judge that it seemed like a high amount. Fabian countered that it was very reasonable, and set the bail at that amount.
Polusí next court appearance is set for September 8 at 1:15 p.m.
