Trial continued for man charged in assault

The trial for Wayne Alan Polus, La Crescent, has been continued.

Polus, 48, is charged with third degree criminal sexual conduct in an August 29 incident in La Crescent. He has pled not guilty.

Third degree criminal sexual conduct is a felony that carries a maximum sentence of 15 years in prison and/or $30,000 fine.

His trial had been set for December 16 and 17, but that was changed at a pre-trial hearing on November 22. An omnibus hearing is now scheduled for December 21 at 9 a.m.

Polus, 48, is free on $20,000 unconditional bond. He allegedly assaulted a woman while she was sleeping on a couch at his parentsí home, where he resides, early on the morning of August 29.

Polus was also charged on September 28 with two counts of driving under the influence (DUI) for an incident that allegedly occurred on September 23 in La Crescent. An omnibus hearing for this will take place on January 5 at 10:30.

Polus was convicted for a DUI on March 18, 2000.
