Heartland report available for review
The Minnesota Pollution Control Agency (MPCA) has prepared a Supplemental Environmental Assessment Worksheet for Heartland Energy and Recycling, a tire-derived fuel plant proposed in Preston. The SEAW will be available for public review and comment from Sept. 27 to Oct. 27, 2004.
The SEAW supplements the information provided in Part 23: Stationary Source Emissions, of the original Environmental Assessment Worksheet (EAW) published in February 2003. The MPCA prepared the current SEAW in response to an order of the 3rd Judicial District Court. The court order resulted from a case brought against the MPCA by a citizens' group based in Preston. The matter before the court was the decision of the MPCA Citizens' Board not to require an Environmental Impact Statement on the project. Comments on the current SEAW should address the accuracy and completeness of the information provided. The public comment period for the SEAW does not constitute a re-opening of the original EAW or the air emissions permit for this project. Comments relating to topics outside the scope of the SEAW will be documented and included in the record, but not considered in the decision-making process.

Following the SEAW public notice period, MPCA staff will prepare responses to the submitted comments as well as an item for the MPCA Citizens' Board to review. The Citizens' Board will use information from the SEAW process to make a determination on the need for an Environmental Impact Statement. Following that decision, the case will return to the 3rd Judicial District Court for a final ruling.
