Judge to issue order on sex assault case

Third District Court Judge James Fabian will decide whether to proceed with sexual assault charges against Wayne A. Polus of La Crescent.

Fabian will consider evidence presented at a December 31 omnibus hearing to make that determination.

Polus, 48, is charged with third degree criminal sexual conduct in an August 2004 incident in La Crescent. He has pled not guilty and is free on $20,000 unconditional bond.

Polus allegedly assaulted a woman while she was sleeping on a couch at his parentsí home, where he resides, early on the morning of August 29.

Third degree criminal sexual conduct is a felony that carries a maximum sentence of 15 years in prison and/or $30,000 fine.

Polus was also charged on September 28 with two counts of driving under the influence (DUI) for an incident that allegedly occurred on September 23 in La Crescent. An omnibus hearing for this will take place on January 5 at 10:30. He was convicted for a DUI on March 18, 2000.
