Schutte pleads guilty to vehicular homicide
James Dean Schutte, 24, Rochester, pled guilty on October 13 to one count of criminal vehicular operation resulting in death.
The former Caledonia man was the driver of a Pontiac Grand Prix that crashed into a tree on Green Acres Road in Caledonia on April 6, killing Matthew J. Atkinson, 20, of Backus, Minnesota.
He also pled guilty to one count of criminal vehicular operation resulting in substantial bodily harm and one count of driving after revocation. Another passenger, Kelly Jo Shefelbine, 34, of Rochester, who was in the front seat, had a back injury and two ribs broken.
Schutte also pled guilty to motor vehicle use without consent, which resulted from a different case.
Sentencing will be on December 14 at 9:30 a.m.
Schutte is currently in the Goodhue County Jail in Red Wing because the Houston County Jail is at capacity.
Hearing set for Bostone
An omnibus hearing for an 18-year old Caledonia man charged with two counts of criminal sexual conduct has been set for November 2 at 10:30 a.m.
Enrico Anthony Joseph ìA. J.î Bostone was charged on October 6 with molesting a boy on two occasions in June of 2005 at another residence. The boy was 12 the first time and 13 the second time, according to the criminal complaint.
Count 1 is a first degree charge because Bostone was more than 36 months older than the alleged victim. Count 2 is a third degree charge because Bostone was more than 24 months older than the alleged victim.
Bostone is presently in the Houston County Jail in Caledonia. His bail is $86,000 conditional and $43,000 unconditional.
Mailbox vandals sentenced
Three adults pled guilty on October 10 to disorderly conduct citations stemming from mailbox vandalism.
Brandon D. Gluch, 19; Jon B. Goetzinger, 18; and Matthew A. Goetzinger, 19, each were fined $300, with Judge James Fabian staying $150. With a $72 surcharge and $10 law library fee, each person had a total fine of $232. The judge also stayed a 10 day jail sentence for each man. The victims of the vandalism have 90 days to seek restitution.
The 16-year-old juvenile male was sentenced to a diversion program because he did not have a previous record, assistant county attorney Sue Harnack said on October 14.
The vandalism occurred on Cork Hollow Road in rural Brownsville on August 16 at 1:30 a.m.
Marijuana case hearings set
Omnibus hearing dates have been set for the two men charged in a marijuana-growing case in Houston County.
Mark Casey Richmond, 37, of Houston, will appear in court on November 2. Patrick Daniel Dingley, 37, of Rochester will appear on December 5.
The men were charged with four counts of third degree conspiracy to manufacture drugs on September 15. They are accused of growing 286 marijuana plants in three different groves on U.S. Fish and Wildlife land and the Gillette property near the Root River in rural Hokah Township.
Dingley and Richmond are both free on bail. Another arrest may be made in the case, but the case is taking a longer time to compile because multiple law enforcement agencies are involved, county attorney Rick Jackson said on October 14.
Taylor requests jury trial
Jack David Taylor, Caledonia, requested a jury trial on October 12 for two counts of assault in the fifth degree and one count of false imprisonment that were filed against him on September 2. No trial date had been set as of October 17.
Taylor is in the Houston County Jail and doing Sentence to Serve work. He will make his next court appearance on October 26 at 9 a.m.
Taylor is accused of hitting a 14-year-old boy and locking him in a cellar for 5-10 minutes at Taylorís house on August 2.
Fifth degree assault charges have also been filed against a juvenile in the case.
Taylor also faces two counts of fifth degree assault for an incident that allegedly occurred in Houston on July 31, 2005. He was charged on September 30, and has requested a public defender. He will make his next court appearance on this on October 26 at 9 a.m.
