Nierling trial date set
A jury trial for Charles R. Nierling, 30, has been set for June 1 in Third District Court in Caledonia.
Nierling pled not guilty to third and fourth degree criminal sexual conduct on March 1. A pre-trial hearing will be held on May 9.
Nierling is accused of raping a woman at her boyfriendís house in Eitzen in the early morning hours of May 17, 2005 He is now out on bail.
Third degree criminal sexual conduct carries a maximum penalty of 15 years in prison and $30,000 fine. Fourth degree criminal sexual conduct carries a maximum penalty of 10 years in prison and a $20,000 fine.
OíBrien appears in court
Darrell Edward OíBrien, 18, Caledonia, appeared in court on March 14. Judge James Fabian ordered a Rule 20 competency evaluation, gave notice of evidence and identification procedures, and filed a a request for disclosure.
OíBrien was charged on March 6 with burglary in the second degree, burglary in the third degree, felony theft, and misdemeanor theft. The charges are connected to a March 1 burglary in Caledonia Township. He is currently in the Goodhue County Jail. Bail has been set at $40,000 unconditional and $20,000 conditional.
Felony charges are also pending against OíBrien in La Crosse Wisconsin for a bomb scare and disorderly conduct. His trial there is set for March 29.
