Caledonia man charged with burglary, assault

John Michael Luhman, 18, faces numerous charges after an incident on May 3 in Caledonia.

Luhman, who lives at 1011 Sunrise Lane, allegedly kicked open the door at his former girlfriendís house at about 3 p.m. and forced her to the ground.

Two police officers and a county deputy responded to the womanís home after she placed a 9-1-1 call.

They found Luhman outside with his face covered with blood. He told officers that he had head-butted a window in the alley between the Caledonia Haulers and Schmitz Bus Company building. He admitted he had kicked the womanís door in, according to the criminal complaint.

Officers let Luhman walk around and smoke a cigarette in order to try to calm him down, because he appeared agitated and belligerent. Luhman then calmed down, and agreed to let Caledonia police officer James Stemper look at his injuries.

When the ambulance arrived, Luhman became belligerent again and would not get into the vehicle, the report states. It says the officers decided to restrain him, but he was able to head-butt Stemper, causing Stemperís nose to bleed.

Officers forced Luhman to his knees, but he would not lay down, the report states. They then used a five second drive-stun from a Taser in Luhmanís back, ìwhich caused him to immediately cease physical resistance,î the complaint states.

Luhman was taken by ambulance to Winona Community Memorial Hospital, accompanied by Stemper. A doctor put 12 staples in Luhmanís scalp to close the laceration.

He was charged with 11 counts on May 4: first degree burglary, a felony; two counts of fourth degree assault and one count of obstructing the legal process, which are gross misdemeanors; and two counts of domestic assault, two counts of fifth degree assault, one count of disorderly conduct, and one count of criminal damage to property, all misdemeanors.

Judge James Fabian set bail at $10,000 unconditional and $5,000 conditional. Luhman posted bail on May 4. His next court appearance, a Rule 8 hearing, is May 15 at 10:15 a.m.
