Judge orders writ for Brownsville
The Third District Court has ordered the City of Brownsville to enforce its zoning ordinance.
Judge James Fabian issued a writ of mandamus for the City of Brownsville and three individuals, including mayor Tim Serres, on May 15.
A writ of mandamus is a court order that requires another court, government official, public body, corporation or individual to perform a certain act.
Steve Lee of Brownsville filed the writ on May 6. He alleges that the city has failed to enforce its zoning ordinance. The writ lists six dates from February 2004 to February of this year in which complaints were made to the city about junk. It also includes photos from different properties.
The city council members listed on the writ are Tim Serres, mayor; and Jim Driscoll, Joe Serres, Gary Schulze, and Rick Voshart.
The three individuals listed are Tim and Mary Serres and James Rohrer.
Judge Fabian set a hearing date of Tuesday, June 6 at 8:30 a.m. to address the issue.
