STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
You are hereby summoned and required to serve upon Plaintiffs attorney an answer to the Complaint, which is herewith served upon you, within twenty (20) days after service of this Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
This action involves, affects or brings into question real property situated in the County of Houston, State of Minnesota described as follows:
That part of the Northwest Quarter of the Northeast Quarter and that part of the Southwest Quarter of the Northeast Quarter of Section 23, Township 103 North, Range 5 West, Houston County, Minnesota described as follows.
Commencing at the northwest corner of said Northwest Quarter of the Northeast Quarter; thence on an assumed bearing of South 00deg.3524 West, along the west line of said Northwest Quarter of the Northeast Quarter, 979.82 feet to the northwest corner of the South 10 acres of said Northwest Quarter of the Northeast Quarter and to the point of beginning; thence continuing South 00deg.3524 West, along the west line of said Northwest Quarter of the Northeast Quarter and said Southwest Quarter of the Northeast Quarter, 1585.16 feet to a point 53.35 feet north of the southwest corner of said Southwest Quarter of the Northeast Quarter; thence North 86deg.5950 East 63.78 feet; thence North 01deg.3224 East 597.13 feet; thence North 01deg.2542 East 66.09 feet; thence North 01deg.3232 East 919.76 feet to the north line of said South 10 acres of the Northwest Quarter of the Northeast Quarter; thence South 89deg.3406 West 89.82 feet to the point of beginning.
The above described parcel contains 2.79 acres and is subject to any easements, covenants, and restrictions of record.
Together with a perpetual easement for ingress and egress over, under, and across that part of the Southwest Quarter of the Northeast Quarter of Section 23, Township 103 North, Range 5 West, Houston County, Minnesota, described as being a strip of land 66.00 feet in width, lying 66.00 feet south of the following described line:
Commencing at the northwest corner of the Northwest Quarter of the Northeast Quarter of said Section 23; thence on an assumed bearing of South 00deg.3524 West, along the west line of said Northwest Quarter of the Northeast Quarter and the west line of said Southwest Quarter of the Northeast Quarter, 1903.94 feet to the north right of way line of the existing Township Road and to the point of beginning of the line to be described; thence North 85deg.5519 East, along the northerly extension of said north right of way line, 74.77 feet and there terminating.
The westerly end of said easement is to be prolonged or shortened to begin on the west line of said Southwest Quarter of the Northeast Quarter. The easterly end of said easement shall be prolonged or shortened to end on a line that bears South 01deg.2542 West from the point of termination.
The object of this action is to determine that the Defendants have no right, title, estate, interest or lien in or on the above described real property.
NOTICE OF NO PERSONAL CLAIM
No personal claim is made against any of the Defendants in the above-entitled matter.
