Court rules in city’s favor with police labor grievance |
By Charlie Warner
Argus News Editor
Fillmore County District Court Judge Robert Benson ruled in the city’s
favor in a labor grievance filed by the Caledonia Police Association’s
labor union. After hearing testimony on March 11, Judge Benson rendered
his decision April 2. The judge’s findings were made public during the
April 14 Caledonia City Council meeting.
The city asked the court to determine if the current labor agreement
between the Police Association and the city precludes the Police
Association from filing a grievance against the city and also to
restrain the Police Association from arbitrating the current grievance
against the city, along with such other relief as the court may deem
just and equitable together with costs and disbursements.
The grievance filed by the Police Association stems from Officer Jim
Stemper being promoted to the rank of sergeant by Chief Randy
Shefelbine, and the city council determining the promotion was not in
the realm of what Shefelbine could actually do.
In the order handed down Judge Benson:
•Granted the city’s motion for an order staying the arbitration proceedings;
•Denied the city’s motion for an award of attorney’s fees;
•Denied the Police Association’s motion for an order compelling arbitration; and
•Denied the Police Association’s motion for an order dismissing the
matter pursuant to Minnesota Rules of Civil Procedures Rule 12.02.
According to City Attorney Tim Murphy, the court ruled the city had the
right to make the managerial decision, and the Police Association has
withdrawn its arbitration grievance.
