PUBLIC USE OFF-HIGHWAY VEHICLE TRAIL MORATORIUM Resolution #2012-4 The Yucatan Township Board of Supervisors hereby creates and authorizes a planning commission to conduct a study of public-use motorized vehicle recreational and racing trails for off-highway vehicles, to determine if such public-use motorized recreational trails cause any significant injury to public health, water quality and contamination, excessive water consumption, excessive noise, traffic hazards, road repair and maintenance problems, land erosion, property value deterioration, damage to nearby rivers and streams, and environmental degradation; and to make land use recommendations to this Board of Supervisors. The Yucatan Township Board of Supervisors approves an interim ordinance or moratorium prohibiting all public-use motorized vehicle recreational and racing trails intended for use by off-highway vehicles within Yucatan Township for a period of one year, effective immediately. During the period of this moratorium, no person or property owner will allow land within this township to be prepared, constructed, developed or used for any public-use motorized vehicle recreational and racing trails intended for use by off-highway vehicles. Excluded and exempted from this moratorium and its prohibition are: (i) public or private use snowmobile trails used by operators of snowmobiles during the winter months, and (ii) private-use motorized vehicle trails intended for use by off-highway vehicles on private property operated by their property owners for agricultural and recreational purposes.
